Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Sol Anna website, the Sol Anna Genesis NFT collection, and any associated features, including wallet connection, holder dashboards, and AI chat functionality (collectively, the "Service"), operated by Sol Anna Genesis ("Sol Anna," "we," "us"). By accessing the Service or acquiring a Sol Anna Genesis NFT, you agree to these Terms.

1. Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction, to acquire a Sol Anna Genesis NFT or use any AI chat feature offered as part of the Service. By using the Service, you represent that you meet this requirement. We reserve the right to implement age verification measures for chat and other interactive features, and to restrict access to any user we cannot verify.

2. What You Own

A Sol Anna Genesis NFT is a digital collectible recorded on the Solana blockchain. Ownership of an NFT gives you:

  • The token itself, as recorded on-chain, including its permanent Genesis number and mint provenance.
  • A personal, non-exclusive, non-transferable (except as bundled with the NFT itself) license to display the associated artwork for personal, non-commercial use.
  • Access to any interactive features (dashboard, chat, personality evolution) tied to that specific NFT, for as long as we offer those features.

Ownership of an NFT does not transfer copyright, trademark, or other intellectual property rights in the underlying artwork, character, brand, or software to you. We retain all such rights, subject to the license above.

3. Evolving Personality & Data Tied to Your NFT

Each Sol Anna Genesis NFT is designed to develop an evolving "personality" profile based on interactions between the NFT and its holder(s) over time. You understand and agree that:

  • This evolving profile is generated and maintained by our systems and is associated with the NFT, not stored on-chain in full.
  • When an NFT changes wallets, the new holder may be given a choice to continue the existing evolution ("CONTINUE") or begin fresh ("RESET"), as described on the Service at the time of transfer.
  • Private conversation content between a holder and their Anna is not made public and is not transferred to a new holder upon sale, regardless of whether the new holder chooses CONTINUE or RESET.
  • We do not guarantee that any specific personality trait, interaction history, or feature will persist indefinitely, and we may modify, discontinue, or migrate the underlying system that powers these features.

4. Blockchain Transactions Are Irreversible

Transactions on the Solana blockchain, including minting, transferring, and burning of NFTs, are irreversible once confirmed. We are not able to reverse, refund, or recover a transaction made in error, including but not limited to sending an NFT to the wrong wallet address, loss of access to your wallet, or loss of your private keys or recovery phrase. You are solely responsible for the security of your wallet and private keys.

5. No Guarantee of Value or Future Features

Sol Anna Genesis NFTs are collectibles. We make no representation or guarantee regarding their future monetary value, liquidity, or resale price. Planned features described on the Service (including but not limited to the holder dashboard, chat functionality, and marketplace listings) are forward-looking and may be delayed, modified, or discontinued at our discretion.

6. Royalties

Secondary sales of Sol Anna Genesis NFTs on supporting marketplaces are subject to a creator royalty as configured on-chain at the collection level (currently 3.33%). Royalty enforcement depends on the marketplace facilitating the sale and is not guaranteed on all platforms.

7. Acceptable Use

You agree not to:

  • Use the Service to harass, abuse, or generate unlawful content, including content involving minors.
  • Attempt to circumvent age verification or access controls on interactive features.
  • Use automated means to scrape, exploit, or interfere with the Service or the fairness of the mint or marketplace listings.
  • Misrepresent your affiliation with Sol Anna or use our marks, art, or brand in a way that implies endorsement without our written permission.

8. Disclaimers

The Service, including any AI-generated chat or personality content, is provided "as is" and "as available," without warranties of any kind, whether express or implied. AI-generated responses may be inaccurate, unexpected, or unsuitable for all audiences. We do not warrant that the Service will be uninterrupted, secure, or error-free.

9. Limitation of Liability

To the fullest extent permitted by law, Sol Anna and its team will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of funds, digital assets, or data, arising from your use of the Service, including losses resulting from blockchain network issues, third-party wallet or marketplace failures, or smart contract behavior.

10. Changes to These Terms

We may update these Terms from time to time. Material changes will be reflected by an updated "Last updated" date above. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
